RELEASE OF LIABILITY
PLEASE READ CAREFULLY BEFORE SIGNING
The undersigned Instructor Training Course participant (“Participant”) in a Core Educational Instructor Training Course (Certification, Workshop or Demo)
presented by Schwinn®, StairMaster®, Star Trac®, Nautilus® and or Throwdown®, hereby assumes all risks known or unknown, associated with such participation in the Instructor Training Course. Participant recognizes that there are inherent risks in taking part in Instructor Training Courses, using health and fitness equipment, participating in cardiovascular and strength training exercises and exercising, including possible permanent disability or death. Participant agrees to assume all of those risks and voluntarily chooses to take part in the Instructor Training Course
Participant hereby certifies that he/she is feeling well, without illness and is physically fit and has not been otherwise informed by a physician or other health care professional that he/she should not participate in the Instructor Training Course. Participant acknowledges that he/she has been given opportunity to read this Agreement and understands its content.
Participant specifically acknowledges that he/she is not an employee of Core Health & Fitness, LLC.
In consideration of Core allowing Participant to take part in the Instructor Training Course, Participant, on behalf of himself/herself, assumes all risks and hereby waives any and all rights to claims for economic loss or damages, including without limitation, any and all claims for loss or damages caused by any act or omission of Core including negligence and any product liability claims, that the Participant may claim to have against Core its parent, affiliated companies, their respective directors, officers, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) as a result of any injury, including death, sustained in connection with participation in the Certification. Further, Participant hereby agrees that each of the Released Parties shall be forever held
harmless and indemnified for any harm, illness (including but not limited to, the Corona Virus, Covid19), injury, damage or loss to person and/or property that Participant may sustain and/or incurred.
This release shall be binding upon the successors, assigns, subrogors, distributees, heirs, next of kin, executors and administrators of the undersigned and may be pled by any of the Released Parties as a complete bar and defense to any claim, demand, action or cause of action by or on behalf of the Participant.
This release applies to and includes all unknown, unforeseen, unanticipated and unsuspected injuries, illness, damages, loss and liability, and the consequences thereof, as well as those now disclosed and known to exist. The provision of any state, federal or local law or statute providing in substance that releases shall not extend to claims, demands, injuries, illness or damages which are unknown or unsuspected to exist at the time to the Participant executing this release is hereby expressly waived.
I hereby grant Core (“the organization”) permission to use my likeness in photographs, video recordings or electronic images, quotes and feedback in any and all of its publications, including website entries, without payment, royalties or compensation or any other consideration. I understand and agree that these materials will become the property of the organization and will not be returned.
I am 18 years of age or older and I am competent to contract in my own name. If I am under age 18, a parent or guardian has signed below. I have read this release before beginning the Instructor Training Course and I fully understand the contents, meaning and impact of this release.
